By purchasing, installing, or using any Drumming Solutions Australia product, including Lugg Lockers, Kick Lugg Lockers, the Drumstick Caddy, Drum Anchor, Drum Anchor Pedal Edition, or Drum Anchor Rack Edition, you agree to the following terms and conditions.
Product Purpose
Drumming Solutions Australia products are designed to assist drummers with practical setup, tuning, positioning, and performance-related issues.
Lugg Lockers and Kick Lugg Lockers are designed to assist in reducing unwanted loosening of drum tension rods during normal playing conditions. They are intended for use on compatible drum hardware when installed correctly and without force.
The Drumstick Caddy is designed to hold spare drumsticks in an accessible position on compatible bass drums. It is intended to assist drummers by keeping spare sticks within easier reach during normal playing conditions.
Drum Anchor, Drum Anchor Pedal Edition, and Drum Anchor Rack Edition are designed to assist in reducing unwanted movement, creeping, or slipping of drums, pedals, stands, racks, and other compatible drum hardware on suitable drum rugs or compatible carpeted surfaces. They may also assist as setup position markers or memory-lock-style placement guides.
Drum kits, lugs, hoops, tension rods, bass drum sizes, stick sizes, pedals, stands, racks, rugs, carpets, finishes, materials, brands, ages, and manufacturing tolerances vary widely. For this reason, correct sizing, surface compatibility, and careful installation are essential.
Correct Fit, Surface Compatibility, and Installation
Customers are responsible for confirming that the selected product is suitable for their intended use before installation.
For Lugg Lockers and Kick Lugg Lockers, customers are responsible for confirming that the selected size matches their drum lug measurement prior to installation.
For the Drumstick Caddy, customers are responsible for confirming compatibility with their bass drum size, lug count, lug spacing, drumstick size, and intended mounting position before use.
For Drum Anchor products, customers are responsible for confirming that their drum rug or carpeted surface is suitable for hook Velcro attachment. Drum Anchor products are designed to work only on compatible rugs or carpets where the hook material can grip securely into the surface fibres.
Drum Anchor products are not suitable for all surfaces. They may not work correctly on Persian rugs, shaggy carpets, long-pile carpets, smooth mats, rubber surfaces, non-compatible drum rugs, or any surface where hook Velcro does not grip securely.
Before using Drum Anchor products, customers should test their rug or carpet by pressing a piece of hook Velcro firmly onto the surface. If the hook Velcro grips strongly and resists sideways movement, the Drum Anchor product should be suitable. If the hook Velcro lifts easily, slides, or does not grip properly, the Drum Anchor product should not be used on that surface.
No Drumming Solutions Australia product should be forced onto, into, around, under, or against any drum, lug, tension rod, hoop, pedal, stand, rack, carpet, rug, or other hardware component. If resistance is felt, the fit appears incorrect, the product does not sit properly, or the product appears unsuitable for the intended use, use should be discontinued immediately.
Use of any Drumming Solutions Australia product with incorrect sizing, incompatible hardware, unsuitable surfaces, forced installation, modification, or misuse is considered improper use.
Warranty and Remedy
If a Drumming Solutions Australia product experiences a serious failure under normal use and correct installation, the customer may be entitled to a replacement, refund, or other remedy in accordance with applicable consumer laws.
To assess a warranty claim, Christian Nativo or Drumming Solutions Australia may request reasonable proof, which may include photos, video, measurements, details of the drum or hardware being used, confirmation that the correct product was selected, confirmation of correct installation, and evidence of the product’s condition.
For Lugg Lockers and Kick Lugg Lockers, this may include clear measurement of the lug being used, including flat-to-flat measurement where applicable, confirmation that the correct size was selected, and photos or video showing the product and its installation.
For the Drumstick Caddy, this may include photos or video showing the bass drum size, lug spacing, lug count, stick size, installation position, and how the product was used.
For Drum Anchor products, this may include photos or video showing the rug or carpet surface, hook Velcro compatibility, product placement, hardware placement, and how the product was used.
Normal wear and tear, cosmetic marks, surface scuffs, dirt, dust, fibre build-up, loss of grip due to unsuitable rug or carpet surfaces, damage resulting from incorrect sizing, forced installation, incompatible hardware, incompatible surfaces, modification, or misuse are not considered product failure.
Assumption of Risk
By using Drumming Solutions Australia products, you acknowledge that drum kits, drum hardware, pedals, stands, racks, rugs, carpets, sticks, finishes, and accessories are subject to normal wear, individual setup differences, playing style, environmental conditions, and variations in materials, finishes, and tolerances.
In the unlikely event that damage occurs to tension rods, lugs, hoops, shells, bearing edges, finishes, pedals, stands, racks, rugs, carpets, drumsticks, accessories, or any other part of a drum kit or related equipment during use, the user accepts responsibility for that risk unless a confirmed product failure under normal use and correct installation is established.
Customers are responsible for inspecting their equipment before and after use and ensuring that each product remains suitable for their setup and playing conditions.
Limitation of Liability
To the fullest extent permitted by law, Christian Nativo and Drumming Solutions Australia are not liable for damage to drums, drum hardware, drumsticks, pedals, stands, racks, rugs, carpets, finishes, accessories, or related equipment arising from the use, misuse, incorrect sizing, incorrect installation, forced installation, incompatible surfaces, incompatible hardware, modification, or improper use of Drumming Solutions Australia products.
This includes, but is not limited to, damage to tension rods, lugs, hoops, shells, bearing edges, drum finishes, tuning components, pedals, hi-hat stands, double pedals, rack legs, rack clamps, cymbal stands, drum rugs, carpets, drumsticks, or accessories.
No Guarantee of Outcome
While Drumming Solutions Australia products are designed to assist with common drummer-related issues, results may vary depending on playing style, tuning tension, drum condition, hardware design, rug type, carpet type, pedal type, stand weight, rack setup, stick size, environmental conditions, and overall setup.
No guarantee is made that Lugg Lockers or Kick Lugg Lockers will provide identical tuning stability across all drum kits, tuning ranges, playing styles, or playing conditions.
No guarantee is made that the Drumstick Caddy will suit every bass drum, lug layout, stick size, player preference, or setup position.
No guarantee is made that Drum Anchor products will prevent all movement on every rug, carpet, surface, drum setup, pedal setup, stand setup, or rack setup. Drum Anchor products rely on surface compatibility, correct placement, and the ability of hook Velcro to grip securely into the rug or carpet fibres.
Acceptance of Terms
By purchasing, installing, or using any Drumming Solutions Australia product, including Lugg Lockers, Kick Lugg Lockers, the Drumstick Caddy, Drum Anchor, Drum Anchor Pedal Edition, or Drum Anchor Rack Edition, you confirm that you have read, understood, and agreed to these terms and conditions.
If you do not agree with these terms, the products should not be used.
